By downloading, installing, or using Kliper, you agree to be bound by these Terms of Service. If you don't agree with any part of these terms, please don't use Kliper.

These terms apply to:

• The Kliper desktop application (free and Pro versions)
• Our website at usekliper.com
• Any associated services or features we provide

2. License and Use Rights

2.1 Free Version

Kliper Starter is free to use for personal and commercial purposes. We grant you a non-exclusive, non-transferable license to:

• Install Kliper on devices you own or control
• Use Kliper to create screen recordings
• Use, modify, and distribute recordings you create (they're yours!)
• Use Kliper for personal or commercial projects

2.2 Pro Version

Pro features require a one-time payment. Your license includes:

• All features from the free version
• Additional Pro features as described on our pricing page
• Lifetime access to Pro features
• Updates and bug fixes for the lifetime of the product

3. User Responsibilities

3.1 Legal Use Only

You agree to use Kliper legally and ethically. This means:

• Respect privacy: Don't record people without their consent where legally required
• Respect copyright: Don't record copyrighted content you don't have rights to
• No malicious use: Don't use Kliper for surveillance, harassment, or illegal activities
• Follow local laws: You're responsible for complying with recording laws in your jurisdiction
• No harmful content: Don't create recordings that violate laws or promote harm

3.2 Account Security (Pro Users)

If you create a Pro account:

• You're responsible for maintaining the security of your account
• Don't share your login credentials
• Notify us immediately at contact@usekliper.com if you suspect unauthorized access
• You're responsible for all activity under your account

4. Ownership and Intellectual Property

4.1 Your Content

You own 100% of the recordings you create with Kliper:

• We claim no ownership or rights to your recordings
• You can use, sell, license, or distribute your recordings however you want
• The watermark on free version recordings doesn't affect your ownership
• You're solely responsible for your recordings' content

4.2 Our Software

Kliper's software, design, and branding remain our property:

• You can't reverse engineer, decompile, or modify the Kliper app
• You can't resell or redistribute Kliper itself
• You can't remove or obscure our branding or copyright notices
• Our logo, name, and trademarks are protected

5. Pro Payment Terms

5.1 One-Time Payment

Pro is a one-time purchase with lifetime access:

• Pro is a one-time purchase with lifetime access
• Prices are as listed on our pricing page at the time of purchase
• Taxes may apply based on your location
• No recurring charges or subscription fees

5.2 Refunds

Refund policy for Pro purchases:

• We do not offer refunds. You can test the free version before purchase.

6. Service Availability and Changes

6.1 Service Uptime

We strive to keep Kliper available and functional:

• The core recording features work entirely offline
• We don't guarantee 100% bug free app but will work quickly to resolve issues

6.2 Changes to Service

We may update Kliper over time:

• We'll add new features and improvements
• We may modify or discontinue features with reasonable notice
• Core functionality (local recording and editing) will always remain available
• Updates may be automatic or require manual installation

7. Warranties and Disclaimers

7.1 Software Provided "As Is"

While we work hard to make Kliper reliable:

• Kliper is provided "as is" without warranties of any kind
• We don't guarantee error-free or uninterrupted operation
• We're not liable for lost recordings due to technical issues
• You should maintain backups of important recordings
• We make no warranties about compatibility with all systems

7.2 Third-Party Services

For Pro features using third-party upload services:

• YouTube and Google Drive integrations depend on those services
• We're not responsible for issues with third-party platforms
• Those services have their own terms you must comply with
• We only facilitate uploads to your own accounts - no proprietary cloud storage

8. Limitation of Liability

To the maximum extent permitted by law:

• We're not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the last 12 months
• For free users, our liability is limited to $100 USD
• We're not liable for data loss, business interruption, or lost profits
• These limitations don't apply where prohibited by law

9. Termination

9.1 Your Right to Stop Using Kliper

You can stop using Kliper anytime:

• Simply uninstall the app from your device
• Cancel your Pro subscription if applicable
• Your recordings remain yours and accessible

9.2 Our Right to Terminate

We may terminate your access if:

• You violate these terms
• You use Kliper for illegal purposes
• You abuse our systems or services

We'll provide notice when possible, except for severe violations.

10. Privacy and Data

Your use of Kliper is also governed by our Privacy Policy. Key points:

• We don't store or access your recordings
• We collect minimal data (see Privacy Policy)
• You control all your data
• We prioritize your privacy at every step

11. Dispute Resolution

If you have an issue with Kliper:

• We'll work in good faith to resolve any problems
• Most issues can be resolved through direct communication

11.2 Governing Law

These terms are governed by the laws of the jurisdiction where Kliper is based, without regard to conflict of law principles. Any disputes will be resolved in the courts of that jurisdiction.

12. General Terms

12.1 Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Kliper.

12.2 Changes to Terms

We may update these terms:

• We'll update the "Last Updated" date at the top
• Major changes will be announced through the app or email
• Continued use after changes means you accept the new terms
• Previous versions available upon request

12.3 Severability

If any part of these terms is found to be unenforceable, the rest remains in effect.

12.4 No Waiver

Our failure to enforce any right doesn't waive that right for the future.
